Intermediate Sanctions Imposed on Waterford Area Partnership clg

The Charites Regulatory Authority (‘Charities Regulator’) has imposed intermediate sanctions on Waterford Area Partnership clg (Registered Charity Number 20035228) under section 73 of the Charities Act 2009.
The intermediate sanctions have been imposed due to the failure of Waterford Area Partnership clg to submit an Annual Report to the Charities Regulator as required by section 52 of the Charities Act 2009.
A notice under section 73 of the Charities Act 2009 was issued to Waterford Area Partnership clg on 17th February 2021 and the Charity Trustees subsequently accepted the imposition of intermediate sanctions by the Charities Regulator and gave an undertaking to:
(a) rectify the contravention no later than 31st March 2021 by the submission of the outstanding Annual Report,
(b) adopt the following course of action for the purpose of ensuring that the contravention does not occur again:
(i) introduce formal documented procedures for maintaining adequate records and allocate appropriate resources which allow for the preparation of the Annual Report;
(ii) assign the task of preparing the Annual Report to a person(s) with the appropriate skills and experience;
(iii) ensure that the preparation and submission of the Annual Report is a standing agenda item as part of all meetings of the Charity Trustees.
The intermediate sanctions imposed under 73 of the Charities Act 2009 consist of the following:
- the removal of the Charity from the Register of Charities for the period from 26th February 2021 until 31st March 2021, and
- the publication of particulars of the contravention concerned on the website of the Charities Regulator.
